GENERAL TERMS AND CONDITIONS (GTC) OF SUN-LOUNGERS.COM AND SUN-LOUNGERS.DE
- Conclusion of Contract and Scope of Application
1.1 The subject matter of the contract is all deliveries of goods by Sun-Loungers (hereinafter referred to as the “Seller”). These GTC apply to consumers and entrepreneurs alike. Any customer conditions shall not apply unless expressly agreed upon.
1.2 These GTC also apply accordingly to the purchase of vouchers, unless otherwise agreed.
1.3 In addition to our GTC, the GTC of www.muse.de also apply to any design orders.
- Offers and Conclusion of Contract
2.1 The online shop presents outdoor furniture and accessories. The product descriptions shown in the shop are invitations to submit an offer by the customer, but not binding offers.
2.2 The customer submits a binding offer by completing the online order form or by email. Acceptance usually takes place immediately but no later than within five days through written order confirmation, delivery, or payment request.
2.3 The acceptance period begins on the day following the customer’s submission of the offer and ends on the fifth day thereafter. If not accepted within this period, the customer is no longer bound by the offer.
- Right of Withdrawal
3.1 Consumers have a right of withdrawal, see the Seller’s withdrawal policy.
3.2 The right of withdrawal does not apply to consumers outside the EU without a residence and delivery address within the EU.
- Prices, Payment Terms, and Shipping Costs
4.1 All prices are final prices including statutory VAT. Additional delivery and shipping costs are separately stated in the product description.
4.2 For deliveries outside the EU or to islands, additional costs may arise, which are to be borne by the customer (e.g., transfer fees, customs duties).
4.3 Payment options are communicated in the shop. Accepted payment methods: advance payment by bank transfer, PayPal, Amazon Payments, and credit card payment (VISA, MasterCard, American Express).
4.4 In the case of advance payment by bank transfer, the amount is immediately due. The bank details for the transfer will be provided after completing the order.
4.5 Acceptance for PayPal payments is made by clicking the order button. Payment is made directly through the PayPal account. Acceptance is confirmed by clicking the order button. 4.6 Amazon Payments: When selecting this payment option, the processing is carried out via the payment service Amazon Payments. Acceptance is confirmed by clicking the order button. - Delivery Conditions and Retention of Title
5.1 Delivery is made to the delivery address provided by the customer. In the case of payment via PayPal or Amazon Payments, the delivery address stored with these services is decisive.
5.2 The risk of accidental loss or deterioration of the goods passes to the customer upon handover to the carrier. This applies to both consumers and entrepreneurs.
5.3 In the case of self-collection by the customer, shipping costs are waived. Collection can take place at our location by prior arrangement [location address will be coordinated with the customer beforehand]. Please contact our customer service in advance to arrange a collection date.
5.4 Delivery Difficulties: Please note that there may be delivery delays under circumstances beyond our control, such as unforeseen events (e.g., natural disasters, wars, political unrest, transport problems, strikes, or other force majeure events, as well as individual delivery difficulties by our suppliers). In such cases, we will inform you promptly and work together to find a satisfactory solution.
5.5 Retention of Title:
The delivered goods remain the property of the Seller until full payment has been made.
- Additional Services, Design, Planning, and Assembly Work
6.1 Special services, such as planning and assembly work, as well as design services, 3D renderings, and the design of an outdoor area with furniture from sun-loungers.com, are carried out exclusively based on an explicit additional order. The execution of such work requires that the assembly rooms are adequately prepared. All additional services are invoiced separately and are due for payment in advance (50%), at the interim presentation (30%), and the final 20% no later than upon handover or acceptance.
6.2 The Seller’s employees are exclusively authorized to perform work in accordance with the contractual performance obligations. The execution of work beyond the contractually agreed scope requires a separate written agreement. If, nevertheless, on the customer’s request, employees of the Seller carry out additional work, this does not affect the existing contractual relationship between the Seller and the customer. Any additional work, including design services, will be invoiced separately.
- Reservation Regarding Material Variations
7.1 The use of natural materials such as teakwood may lead to customary variations in the surface that are reasonable for the customer. In particular, color and grain deviations in wood surfaces are possible. Furthermore, decorative and textile fabrics are subject to customary variations that are reasonable for the customer. This includes minor differences in execution compared to fabric patterns, especially in terms of color.
Please note that the images shown in the online shop are only an illustration of the furniture pieces and are not necessarily true to reality. Deviations from the images may occur, and the natural variations in materials are part of the unique character of the furniture. Such customary variations do not constitute a defect and do not affect the quality of the furniture.
- Reservation Regarding Image Material
Our efforts are focused on presenting all outdoor furniture in realistic environments, either by using our own image material or relying on image material from our suppliers.
It should be noted that the products shown in the pictures are merely to be understood as illustrative representations and not as pre-assembled ensembles available for purchase. Decorative elements, flower pots, umbrellas, or side tables are solely for illustration and are not included in the purchase price unless expressly listed as part of the respective item.
The purchase exclusively includes the specified item, not the decoration or other materials visible in the pictures. These are presented solely for illustrative purposes and are not part of the purchase agreement.
- Warranty and Liability for Defects
9.1 For consumers, the statutory regulations regarding liability for defects apply.
9.2 Entrepreneurs are subject to a limitation period of one year from delivery (for new goods). For used goods, claims for defects are excluded.
9.3 Limitations of liability do not apply to claims for damages, fraudulent concealment of defects, and certain contractual obligations.
- Voucher Conditions
10.1 Promotions and vouchers can only be redeemed within the specified period. Exclusions for individual products result from the conditions.
10.2 Vouchers are not redeemable for cash or transferable.
- Redemption of Gift Vouchers
11.1 Gift vouchers can be redeemed in the online shop or for style consulting. Gift vouchers can only be used for the purchase of goods and not for the purchase of additional gift vouchers.
11.2 If the value of the gift voucher is not sufficient to cover the order, one of the other payment methods offered by the Seller can be chosen to settle the difference.
11.3 Cash payment of the voucher value is not possible.
11.4 The voucher is transferable to others for a fee of EUR 100.00. Please contact our support if you wish to transfer a gift voucher to someone else.
- Applicable Law and Jurisdiction
12.1 German law applies, excluding the UN Sales Convention.
12.2 If the customer acts as a consumer with a residence in another country, mandatory legal provisions of that country remain unaffected.
12.3 The place of jurisdiction is the registered office of the Seller for customers with a registered office in Germany. Customers outside Germany accept the registered office as the place of jurisdiction.
